Your Loving Memory Limited Terms of Service

Defined terms from Your Loving Memory Ltd [Terms and Conditions] and [Privacy Policy] are used in these specific terms.

The Your Loving Memory service forms part of a Digital Card Service provided by GoPaperless Ltd.

You agree to only submit image files, creative material, photographs, videos, links, comments, and other content (collectively "Content") to Your Loving Memory for a tribute digital card.

You should preserve Content or back-up copies of Content. Your Loving Memory is not a storage provider and does not act as the sole repository of Content.
By submitting Content to Your Loving Memory, you consent to the use of your likeness, and you warrant and represent that you have obtained the written consent, release, and/or permission of every identifiable individual who appears in Content. If any identifiable individual in Content is under the age of eighteen (18), you agree that you have obtained such written consent, release and/or permission from that individual's parents or guardians. If you do not have any of the foregoing, please do not submit Content to Your Loving Memory Ltd.

You agree not to submit any Prohibited Content. Prohibited Content includes, but is not limited to Content that abusive, pornographic, obscene, defamatory, slanderous, violent, offensive, constitutes hate speech or is otherwise inappropriate; infringes or violates applicable law or regulation (for example intellectual property or privacy law); contains viruses, worms, corrupt files, trojan horses or other forms of corruptive code, or any other content which may compromise the Services; advocates illegal activity; harms or advocates harm against anyone; or provides a link to material associated with any of the above.

By submitting Content, you represent and warrant to Your Loving Memory that you either own your Content or have written permission from the copyright (or other intellectual property right) owner to make such Content available to Your Loving Memory and that the Content does not and will not infringe, misappropriate, use or disclose without authorisation or otherwise violate any intellectual property or other proprietary right of any third-party.

All Content is the sole responsibility of the person who submitted it. You are solely responsible for your Content.

Content will be uploaded by Your Loving Memory to the GoPaperless digital card platform. If you are the individual requesting a tribute card, you can request a link to the digital card platform for editing, which will be password protected. You are solely responsible for the sharing of the digital card admin link and its password to third parties. You agree to share the digital card link and password securely and will immediately inform Your Loving Memory if the access to the platform or password is lost, stolen or compromised.

Content may include links to websites, web pages and resources. Any links do not constitute an endorsement or an approval by Your Loving Memory of any of the products, services or opinions of any corporation, organisation or individual. Such links to websites, webpages, and resources are provided for your information only and you access them at your own risk. Your Loving Memory is not liable or responsible for the content or operation of third party websites, webpages or resources.

You retain ownership of your Content and any rights granted to Your Loving Memory are granted as a license. In order for Your Loving Memory to provide a tribute digital card, you hereby grant to Your Loving Memory and its partners, affiliates, subsidiaries, agents, vendors and assigns a perpetual, irrevocable, worldwide right to copy, display, modify, distribute, transmit, and make derivative works of your Content solely for the purpose of providing a tribute card through the GoPaperless digital card platform.

Your Loving Memory provides a Tribute Card “as is” and “as available” and will not be liable for the loss of any Content. Your Loving Memory does not guarantee the accuracy, quality, or appropriateness of Content.

Your Loving Memory may review, modify, move, edit or delete Content, for example by changing the original resolution and format of Content, deleting a picture which has been flagged to us or deleting Prohibited Content.

Your Loving Memory uses third parties in the provision of the 'Tribute Card' through Gopaperless Ltd and as detailed in the Your Loving Memory Privacy Policy, Your Loving Memory may share Content, including personal data with such third parties.

The 'Your Loving Memory' tribute digital card will be accessible for the life of the account technology permitting, following the date of of creation, as applicable, or until the requested party decides that they wish to cancel, at which time the account will remain dormant until reactivated.

Your Loving Memory can destroy or delete on request all Content when it is no longer needed for the purpose for which it was obtained under GDPR compliance.

Where there is any conflict between these specific terms and Your Loving Memory Terms and Conditions and Privacy Policy, these specific terms will prevail.
